    MOP values your privacy. In this Privacy Policy (“Policy/ Privacy Policy”), we describe the manner in which information relating to you is collected, used, disclosed and secured.You are advised to read and understand our Policy carefully, as by accessing the Platform (as described in the Terms of Use) you agree to be bound by the terms and conditions of the Privacy Policy and consent to the collection, storage and use of information relating to you as provided herein. This Policy is a part of and incorporated within, and is to be read along with, the Terms of Use.

    If you do not agree with the terms and conditions of our Privacy Policy, including in relation to the manner of collection or use of your information, please do not use or access MOP.

    For the purpose of this Privacy Policy, wherever the context so requires, "you" shall mean any natural or legal person who uses our Platform, including specifically Customers and Suppliers of MOP.

    Capitalized terms not defined here will be as defined in the Terms of Use available in the Mad Over Pets website.

    1.             COLLECTION, USEAGE AND DISCLOSURE OF PERSONAL INFORMATION

     

    1.1.       “Personal Information” is defined to include information that whether on its own or in combination with other information may be used to readily identify or contact you such as: name, address, email address, phone number etc.

     

    1.2.       As part of the registration process on the Platform, we may collect the following personally identifiable information about you: name, including first and last name, email address, mobile phone number and contact details, postal code, demographic profile (like your age, gender, occupation, address etc.)

     

    1.3.       We may automatically collect certain information like information about the pages on the app you browse, the products you view and order, and any such browsing information based upon your behaviour on the Platform. In this regard, we also collect information about the interaction of your apps, browsers, and devices with our services, including IP address, crash reports, system activity, and the date, time, and referrer URL of your request. 

     

    1.4.       We collect information about your location when you use the Platform in order to provide you a choice of all the Suppliers available in your locality and to enable delivery of the order you place to your address. Your location can be determined with varying degrees of accuracy by way of (i) GPS; (ii) IP address and cell towers.The types of location data we collect depend in part on your device and account settings. For example, you can turn your device’s location on or off using the device’s settings app.

    1.5.       Information including but not limited to credit card, debit card, bank account details, billing address etc. for the purpose of making payments against the orders you place on the Platform.

     

    1.6.       We collect personal information from Suppliers/ service providers offering their products and services. Suppliers and Customers are required to create an account to be able to access certain portions of MOP’s Platform. Suppliers, if and when they create an account with MOP, will be required to disclose and provide to MOP information including personal contact details, bank details, personal identification details (such as PAN card, Aadhar card, phonebook, call logs etc.) and participate in polls or surveys or feedbacks etc. Such information gathered shall be utilized to better service Customers’ needs. The type of personal information we collect from you varies based on your particular interaction with our Platform.

     

    1.7.       If you are a Supplier and would like to post any information about yourself, we will require you to register for an account. During the account registration process, we will collect your business name, telephone number, address, zip code, travel preferences, a description of your services, a headline for your profile, first and last name, and email address. Other information may also be required to be provided to MOP whilst you avail and use MOP’s Platform. In addition, you may, but are not required to, provide other content or information about your business, including photographs and videos. We may also collect payment information, such as credit card information, from you.

     

    1.8.       Background Verification – the Supplier acknowledges that as part of the on-boarding process, MOP or an entity/ agency appointed or nominated by MOP (“Verifier”), may undertake background verification checks of the Supplier in order to authenticate inter alia the genuineness and competency of the Supplier. In light of the above, the Supplier expressly consents to and acknowledges that it does not have any objection to MOP requesting and collecting information as may be reasonably required to fulfil these processes.

     

    2.             HOW WE USE YOUR INFORMATION

     

    2.1.       We only collect and use such information from you that we consider necessary for achieving a seamless, efficient and safe experience, customized to your needs including;

     

    2.1.1. To enable the provision of services opted for by you;

    2.1.2. To enable better collaboration between you and the third party sellers

    2.1.3. To communicate necessary account and product/service-related information/customer support from time to time;

    2.1.4. To allow you to receive quality customer care services;

    2.1.5. To undertake necessary fraud and money laundering prevention checks, and comply with the highest security standards;

    2.1.6. To comply with applicable laws, rules and regulations; and

    2.1.7. To provide you with information and offers on products and services, on updates, on promotions, on related, affiliated or associated service providers and partners, that we believe would be of interest to you.

     

    2.2.       We use your information to send you offers based on your interests and prior activity.

                                            

     

    2.3.       We use billing information, such as your billing address or payment methods to settle payments with third-party payment agents/gateways against your orders on the Platform.

     

    2.4.       We use the information we have to help verify accounts and activity, and to promote safety and security on and off our Platform, such as by investigating suspicious activity or violations of our legal terms and policies.

     

    2.5.       In addition to any personally identifiable data use that is described in this Privacy Policy, we may aggregate information about you and other individuals together, or otherwise "de-identify" your information (meaning that the data is anonymized and aggregated so it no longer personally identifies you). We may use this “de-identified” information for any legitimate internal and external business purpose, including for research and analysis, administration of our Platform and the services therein.

     

    2.6.       MOP shall ask your consent before using your information for a purpose that isn’t covered in this Privacy Policy.

     

    2.7.       We may disclose information that we collect from you or you provide to us, as described in this privacy policy, in the following ways;

     

    2.7.1.      To our subsidiaries and affiliates.

    2.7.2.      To contractors, advertisers/service providers and other third-parties whom we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

    2.7.3.      Payment related information provided by you to us may be shared with third-party payment processors for the sole purpose of settling payments to be made by you or with other third-party service providers (including but not limited to vendors who provide fraud detection services to us and other third parties).

    2.7.4.      to fulfil the purpose for which you provide it or for any other purpose disclosed by us when you provide the information.

     

    2.8.       We may share your information with outside vendors that we use for a variety of purposes, such as to send you communications via emails, messages or tele-call to inform you about our products that may be of interest to you, push notifications to your mobile device on our behalf, provide voice recognition services to process your spoken queries and questions, help us analyze use of our Platform, and process and collect payments. Some of our products, services and databases are hosted by third party hosting services providers. 

     

    2.9.       We may share your information when we believe in good faith that such sharing is reasonably necessary in order to investigate, prevent, or take action regarding possible illegal activities or to comply with legal process.

     

    2.10.   We may also share your information to investigate and address threats or potential threats to the physical safety of any person, to investigate and address violations of this Privacy Policy or the Terms of Use, or to investigate and address violations of the rights of third parties and/or to protect the rights, property and safety of MOP, our employees, users, or the public. This may involve the sharing of your information with law enforcement, government agencies, courts, and/or other organizations on account of legal request such as subpoena, court order or government demand to comply with the law.

     

    2.11.   If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of MOP, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

     

    2.12.   We may share your information in any other circumstances where we have your consent.

     

    3.             ACCESSING & CORRECTING YOUR PERSONAL INFORMATION

     

    3.1.       We will take reasonable steps to accurately record the personal information that you provide to us and any subsequent updates.

     

    3.2.       We encourage you to review, update, and correct the personal information that we maintain about you, and you may request that we delete personal information about you that is inaccurate, incomplete, or irrelevant for legitimate purposes, or are being processed in a way which infringes any applicable legal requirement.

     

    3.3.       Your right to review, update, correct, and delete your personal information may be limited, in the following events:

    3.3.1.      If your requests are abusive or unreasonably excessive,

    3.3.2.      Where the rights or safety of another person or persons would be encroached upon, or

    3.3.3.      If the information or material you request relates to existing or anticipated legal proceedings between you and us, or providing access to you would prejudice negotiations between us or an investigation of possible unlawful activity.

     

    4.             PERMISSIBLE AGE

     

    4.1.       The Platform is not intended for users under the age of 18 (Permissible Age). We do not knowingly collect any personal information from users or market to or solicit information from anyone under the Permissible Age. If we become aware that a person submitting personal information is under the Permissible Age, we will delete the account and any related information as soon as possible. If you believe we might have any information from or about a user under the Permissible Age, please contact us.

     

    5.             HOW WE SECURE YOUR INFORMATION

     

    5.1.       We have implemented appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access to your information and to maintain data security. These safeguards take into account the sensitivity of the information that we collect, process and store and the current state of technology. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. The third party service providers with respect to payment gateway and payment processing are all validated as compliant with the payment card industry standard (generally referred to as PCI compliant service providers).

     

    5.2.       We assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized third-party access, or other causes beyond our control. You play an important role in keeping your personal information secure. You should not share your user name, password, or other security information for your MOP account with anyone. If we receive instructions using your user name and password, we will consider that you have authorized the instructions.

     

    6.             THIRD-PARTY LINKS

    6.1.       The Platform may contain links to third-party websites. Your use of these features may result in the collection, processing or sharing of information about you, depending on the feature. Please be aware that we are not responsible for the content or privacy practices of other websites or services which may be linked on our services. We do not endorse or make any representations about third-party websites or services. Our Privacy Policy does not cover the information you choose to provide to or that is collected by these third parties. We strongly encourage you to read and review such third parties' privacy policies.

     

    7.             DELETION OF YOUR ACCOUNT

     

    7.1.       If you have an account with us, you may choose to delete your MOP account, in accordance with our Terms of Use, via the settings of your MOP account when signed in. Please note that, after you delete your account, you will not be able to sign in to our app or access any of your personal information, however, you can open a new account at any time. If you delete your account, we may still retain some information from or about you in accordance with this Privacy Policy and where permissible under applicable law, including for various legal, operational, analytical, accounting, and auditing purposes. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

     

    8.             MODIFICATIONS TO THE PRIVACY POLICY

     

    8.1.       We reserve the right to amend this Privacy Policy from time to time to reflect changes in the law, our data collection and use practices, the features of our services, or advances in technology. Please check this page periodically for changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is used. If we make any material changes to this Privacy Policy, we will post the changes here. Please review the changes carefully. Your continued use of the Platform following the posting of changes to this Privacy Policy will constitute your consent and acceptance of those changes.

     

    9.             GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION

     

    9.1.       The Privacy Policy shall be governed by and construed in accordance with the laws of India.

     

    9.2.       Any dispute or difference, whether on the interpretation or otherwise, in respect of any terms hereof shall be referred to an independent arbitrator to be appointed by MOP. Such arbitrator’s decision shall be final and binding on the parties. The arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996, as amended or replaced from time to time. The venue of arbitration shall be Hyderabad and the language of the arbitration shall be English.

     

    9.3.       Subject to the aforesaid, the Courts at Hyderabad shall have exclusive jurisdiction over any proceedings arising in respect of the Privacy Policy.
